दिनांक 23/12/2022 को एक अज्ञात शव का डेथ मेमो वास्ते आवश्यक कार्रवाई थाना मुनिकीरेती पर प्राप्त हुआ जिसमे एक अज्ञात व्यक्ति को दिनांक 23/12/2022 को 12:55 प्रातः सोनू शर्मा नाम के व्यक्ति द्वारा मृत अवस्था मे राजकीय चिकित्सालय ऋषिकेश मैं भर्ती किया गया है । डेथ मेमो पर आवश्यक कार्यवाही हेतु प्रभारी निरीक्षक मुनिकीरेती द्वारा उपनिरीक्षक सुनील पंत चौकी प्रभारी कैलाश गेट को निर्देशित किया गया आदेशानुसार उप0नि0 सुनील पंत डेथ मेमो पर पंचायत नामा की कार्यवाही करने हेतु दिनांक 23/12/ 2022 को राजकीय अस्पताल ऋषिकेश गए जँहा में मृत अवस्था में भर्ती किया गए व्यक्ति के शव का निरीक्षण किया तो मृतक के शरीर पर काफी चोटो के निशान होने के कारण मृतक की मृत्यु संदिग्ध प्रतीत हो रही थी इस पर उप नि सुनील पंत द्वारा प्रभारी निरीक्षक मुनिकीरेती को अवगत कराया जो तुरंत मय पुलिस बल के राजकीय अस्पताल ऋषिकेश गए जिनके द्वारा मृतक की शिनाख्त हेतु आस पास काफी प्रयास किये परन्तु शिनाख्त नही हो पायी प्रभारी निरीक्षक मुनिकीरेती द्वारा सूचना से तत्काल उच्चाधिकारीयो को अवगत कराया घटना की मृतक के मुहं पर व सिर पर गहरी चोट होने से मृतक की मृत्यु संदिग्ध प्रतीत होने के कारण घटना की संवेदनशीलता को देखते हुए श्रीमान वरिष्ठ पुलिस अधीक्षक महोदय जनपद टिहरी गढ़वाल द्वारा ASP टेहरी गढ़वाल व क्षेत्राधिकारी नरेंद्र नगर महोदय को मृतक की तत्काल शिनाख्त करने हेतु निर्देशित किया गया आदेश के अनुपालन मे क्षेत्राधिकारी नरेंद्र नगर महोदय द्वारा स्वयं के निर्देशन एवं प्रभारी निरीक्षक मुनी की रेती के नेतृत्व में मृतक की सिनाख्त हेतु व0उ०नि० मुनिकीरेती सहित सादे व वर्दी में 05 टीमों का गठन कर प्रत्येक टीम को मृतक की शिनाख्त हेतु अलग अलग निम्न कार्य दिया गया ।
टीम-1 सीसीटीवी फुटेज चैक करने का कार्य।
टीम-2 मृतक की फ़ोटो दिखा कर आस पास के लोगों से पूछताछ करने का कार्य ।
टीम-3 मृतक के संबंध मे होटल, ढाबो, घाटो व आश्रमों एवम धर्मशालाओं में मृतक के संबंध में पूछताछ करने का कार्य।
टीम-4 डीसीआरबी व एससीआरबी से राज्य व जनपद में गुम हुये व्यक्तियों की सूची प्राप्त कर मृतक के लिये से मिलान करने का कार्य।
टीम-5 बस स्टेशन रेलवे स्टेशन व टैम्पों स्टैण्ड पर मृतक के संबंध मे जानकारी करने का कार्य।
प्रत्येक टीम द्वारा मृतक की सिनाख्त हेतु हर सम्भव व भरसक प्रयास करते हुए लगभग 75 से अधिक सीसीटीवी कैमरें की फुटेज 400 व्यक्तियों से पूछताछ 100 होटल ढाबों में पूछताछ 50 आश्रम व धर्मशालाओं में पूछताछ 200 फड, ठेली, रेडीवालों से पूछताछ, डीसीआरबी व एससीआरबी से 15 गुमसुदा व्यक्तियों की सूची प्राप्त कर मृतक के लिये से मिलान, व ऋषिकेश, हरिद्वार, देहरादून के रेलवे स्टेशन, बस स्टेशन व टेम्पो स्टैण्ड पर मृतक का फोटो दिखा शिनाख्त के काफी अथक प्रयासो के बाद दिनांक 23/12/2022 को मृतक के शव की पहचान 1 रविंद्र शर्मा पुत्र कालू शर्मा निवासी ऋषिकेश 2 सागर राय पुत्र मनोज राय निवासी शीशम झाड़ी मुनिकीरेती 3 शुभम कुमार पुत्र महेंद्र कुमार निवासी शीशम झाड़ी मुनिकीरेती 4 मनोज मंडल पुत्र प्रभु दयाल निवासी कैलाश गेट मुनिकीरेती द्वारा कबाड़ी बाबा के रूप में की गई जिनके द्वारा बताया की यह बाबा पिछले दो-तीन वर्षों से पूर्ण श्मशान घाट पर अकेला रहता था श्मशान घाट के आसपास कबाड़ा बीनने का काम करता था इसके परिजन के संबंध में हमें कोई जानकारी नहीं है इस पर अपने द्वारा मृतक की शिनाख्त कबाड़ी बाबा के रूप में होने पर उप नि सुनील पंत द्वारा मृतक के पंचायत नामे की कार्यवाही करते हुए शव को p.m के लिए भेजा गया ।
गठित टीमो द्वारा मृतक कबाड़ी बाबा को राजकीय अस्पताल ऋषिकेश में भर्ती कराने वाले व्यक्ति सोनू शर्मा पुत्र नरेंद्र शर्मा निवासी शीशम झाड़ी मुनी की रेती नाम के व्यक्ति की तलाश की गई काफी तलाश करने के बाद सोनू शर्मा उपरोक्त पूर्णानंद श्मशानघाट के पास मिला जिससे उप नि सुनील पंत द्वारा मृतक के संबंध में पूछताछ की गई तो सोनू शर्मा द्वारा बताया कि दिनांक 22/12/2022 की रात मैं ही कबाड़ी बाबा को सरकारी अस्पताल ऋषिकेश ले गया था जहां मैंने कबाड़ी बाबा को अस्पताल में इलाज के लिए भर्ती कराया पर डॉक्टर ने बताया कि बाबा मर गया है। दिनांक 22/12/2022 की रात लगभग 11:00 बजे दो लड़के कबाड़ी बाबा को श्मशान घाट के पास रॉड से मार रहे थे जब बाबा जमीन पर गिर गया तब वह दोनों भाग गए तब मैं बाबा को काफी चोट थी और खून बह रहा था तब मैं कबाड़ी बाबा को लेकर राजकीय अस्पताल ऋषिकेश गया ठै जँहा डॉक्टरों ने बाबा को मार हुआ बता दिया मैं उन लड़कों से काफी डर गया था इसलिए मैंने यह बात किसी को नहीं बताई गठित टीमो द्वारा मृतक के परिजनों की तलाश हेतु हर संभव भरसक प्रयास किये परंतु मृतक के परिजनों के संबंध मे कोई जानकारी नही लग पाई सभी के द्वारा बताया कि कबाड़ी बाबा पिछले 2-3 वर्षों से पूर्णनंद शमशान घाट पर अकेला ही रहता था शमशान घाट के आस पास कबाड़ बीनने का काम करता था जिसके परिजनों के संबंध मे किसी को कोई जानकारी नही है। तब दिनांक 24/12/2022 उप नि सुनील पंत द्वारा थाना मुनिकीरेती पर घटना के संबंध में तहरीर जुबानी मु0अ0स0 99/22 धारा 302 भादवि बनाम 2 लोग अज्ञात कायम कायम व दर्ज कराया जिसकी विवेचना व0उ०नि० मुनिकीरेती के सुपुर्द की गयी।

टीम-1 अज्ञात 2 लोगों की तलाश हेतु 120 कैमरों की सीसीटीवी की फुटेज चैक करने के बाद
टीम-2 अज्ञात 2 लोगों की तलाश हेतु घटना घटना स्थल के आस पास के लगभग 300 लोगों से पूछताछ करने के बाद
टीम-3 मृतक के परिचित, दोस्त, रिश्तेदार व परिजनों की काफी तलाश करने के बाद।
टीम-4 अज्ञात 2 लोगों की तलाश हेतु मुखबिर मामूर करने बाद
टीम-5 अज्ञात 2 लोगों की तलाश हेतु राम झूला पार्किंग, लक्ष्मण झूला पार्किंग, कैलाश गेट पार्किंग, नाव घाट, पूर्णानंद घाट, आदि स्थानों पर स्थित 450 से अधिक रेडी/ ठैली कबाड़ी वालों से पूछताछ करने के बाद
विवेचक व गठित टीमो के काफी अथक प्रयास के फलस्वरूप दौराने विवेचना दिनांक 25/11/2022 को मुखबिर की सूचना पर अभियुक्त 1- चौधरी प्रिंस पुत्र बबलू कुमार निवासी ग्राम आजमपुर, मूलसम थाना दोघट तहसील बड़ोत जिला बागपत उत्तर प्रदेश उम्र-20 वर्ष 2- संदीप पाल पुत्र रामपाल निवासी मोहल्ला अजय नगर चौकी कंकरवाली थाना कोतवाली रेवाड़ी जिला रेवाड़ी हरियाणा उम्र-29 वर्ष को गंगा रिजॉर्ट आस्था पथ के पास से समय सुबह 06:05 बजे गिरफ्तार किया गया जिन्होंने पूछने पर बताया कि हम लोग शराब पीने के आदि हैं नशा करने के पैसे ना होने के कारण हमारे द्वारा पैसों के लिए छोटी मोटी चोरी की जाती है लगभग 10-12 दिन पहले हम दोनों ने पूर्णानंद घाट के पास से एक यात्री बैग चोरी किया था बैग चोरी करते समय कबाड़ी बाबा ने हमें देख लिया था और यह बात कबाड़ी बाबा ने उस यात्री को बता दी जिसका हमने बैग चोरी किया था इस पर हमें कबाड़ी बाबा पर काफी गुस्सा आया और उसी दिन हमने सोच लिया था कि इसको मौका मिलने पर सबक सिखाना है तब दिनांक 22/12/2022 की रात हम दोनों शराब पी कर कबाड़ी बाबा के पास गए औऱ कबाड़ी बाबा को रोड से बहुत मारा तभी 2-3 लड़के वहाँ आ गये तब हम वहाँ से भाग गए थे। तभी से हम इधर उधर छिप रहे है। अभियुक्तगणों की निशानदेही परमृतक की मुत्यु में प्रयुक्त आला कतल स्टील की रॉड को बरामद कर । अभिक्तगणों को वास्ते रिमाड मा० न्याया० के समक्ष पेश किया जा रहा है।
