सुप्रीम कोर्ट ने देश की शिक्षा व्यवस्था को लेकर गंभीर टिप्पणी की है. मंगलवार को एक मामले में जस्टिस बीआर गवई और जस्टिस हिमा कोहली की बेंच ने कहा कि देश में एजुकेशन सिस्टम एक इंडस्ट्री बन चुका है, जिन्हें बड़े बिजनेस घराने चला रहे हैं.

मेडिकल कॉलेजों की फीस इतनी बढ़ चुकी है कि डॉक्टरी की पढ़ाई करने के इच्छुक स्टूडेंट्स को यूक्रेन जैसे दूरदराज के देशों तक जाना पड़ रहा है. सुप्रीम कोर्ट की ये तीखी टिप्पणी फार्मेसी काउंसिल ऑफ इंडिया की उस याचिका पर आई जिसमें उसने दिल्ली और कर्नाटक हाईकोर्ट के फैसलों को चुनौती दी है. काउंसिल ने नए फार्मेसी कॉलेज खोलने पर 2020-21 के सेशन से अगले 5 साल के लिए रोक लगाई थी, जिसे हाईकोर्ट ने खारिज कर दिया था.

समाचार एजेंसी पीटीआई के मुताबिक, पीसीआई के आदेश के खिलाफ 88 याचिकाएं हाईकोर्ट में दाखिल की गई थीं. ये याचिकाएं नए फार्मेसी कॉलेज खोलने के इच्छुक लोगों की तरफ से दायर की गई थीं क्योंकि नए कॉलेज खोलने के लिए पीसीआई से अप्रूवल लेना जरूरी होता है. पीसीआई के इस आदेश में पूर्वोत्तर और ऐसे राज्यों को छूट दी गई थी, जहां पर डी. फार्मा और बी. फार्मा के कॉलेजों की संख्या 50 से कम है. पीसीआई के आदेश पर रोक लगाते हुए हाईकोर्ट ने कहा था कि काउंसिल ने अपने अधिकारों से आगे जाकर ये आदेश पारित किया है, ऐसे में इसे जारी नहीं रखा जा सकता. TOI रिपोर्ट के अनुसार, हाईकोर्ट के आदेश के खिलाफ अपील पर सुप्रीम कोर्ट में सुनवाई के दौरान काउंसिल की तरफ से सॉलिसिटर जनरल तुषार मेहता ने कहा कि ये रोक इसलिए लगाई गई थी ताकि फार्मेसी कॉलेजों की बाढ़ पर लगाम कसी जा सके, जिन्हें पैसा कमाने का जरिया बना दिया गया है. इसके लिए ये एजुकेशन के स्टैंडर्ड को भी ताक पर रख देने से नहीं चूक रहे. इस पर जस्टिस गवई की अध्यक्षता वाली वैकेशन बेंच ने कहा कि हर कोई जानता है कि भारत में एजुकेशन एक इंडस्ट्री बन चुकी है. बड़े-बड़े बिजनेस घराने मेडिकल और फार्मेसी कॉलेज चला रहे हैं. इनमें पढ़ाई इतनी महंगी है कि छात्रों को यूक्रेन तक का रुख करना पड़ रहा है. वहां की पढ़ाई यहां के मुकाबले काफी सस्ती है.नए फार्मेसी कॉलेजों की तरफ से पेश एडवोकेट देवदत्त कामत और विनय नवारे ने कहा कि काउंसिल के फैसले को हाईकोर्ट ने इसलिए खारिज किया था क्योंकि ये संविधान के आर्टिकल 19(1)(जी) में दिए गए मूलभूत अधिकारों का उल्लंघन करता है. उन्होंने सुप्रीम कोर्ट से पीसीआई को नए कॉलेजों के आवेदनों पर विचार करने का निर्देश देने का अनुरोध किया. उनका कहना था कि काउंसिल के आदेश की वजह से दो साल पहले ही बर्बाद हो चुके हैं. सभी तरह का इन्फ्रास्ट्रक्चर तैयार होने के बावजूद कॉलेजों की मंजूरी नहीं दी जा रही है.

सुनवाई के बाद कोर्ट ने काउंसिल को निर्देश दिया कि वो नए फार्मेसी कॉलेज खोलने के आवेदनों को स्वीकार करके उन पर विचार करे, हालांकि उन्हें स्वीकार करने या खारिज करने पर अभी कोई फैसला न ले. इस मामले में अगली सुनवाई अब 26 जुलाई को होगी
